New: 2017 Medical Malpractice Trend Review

We’re pleased to release our 43rd and final analysis of medical malpractice verdicts and settlements, as reported by various media outlets. The review entails a national survey of $5million + cases that appear in print and online from January 2016 to June 2017.

We did not find enough available information about verdicts and settlements of $1M or more, and the descriptions of even $5M + cases are down from previous years. We know that many large malpractice awards are achieved via settlements, which are commonly subject to confidentiality agreements, and which limit media coverage.

However, we have found that, as in the past, medical malpractice settlements continue to trend upward.

Key findings:

  • 7 settlements and 34 verdicts totaling $844M
  • $463B awarded in 2017
  • $381B awarded in 2017
  • 30/40 cases in 2016 saw awards of at least 10M
  • 11/13 cases in 2017 saw awards of least 10M (an upward trend)
  • As in the past, major, permanent, or grave injuries, including death, predominate
